Important: in the event of divergence between the French and English versions of the general terms and conditions of sale, the French original shall prevail.

The General Terms and Conditions of Sale shall apply to any order placed via the online shop at www.magstein.ch. These general terms and conditions of sale shall define the contractual relationship:

Any natural or legal person either visiting or making a purchase at the online shop at www.magstein.ch on their own behalf or for a third party, hereinafter the customer.

ARTICLE 1: CONDITIONS FOR PLACING AN ORDER

The customer declares that they have the capacity to conclude this agreement, in other words that they are of legal age and not under guardianship or trusteeship.

Magstein Sàrl reserves the right to amend or modify these general terms and conditions of sale at any time. These will be applicable once they are published online. In the event of an amendment, the general terms and conditions of sale in force on the magstein.ch website on the date on which the order was placed shall apply.

ARTICLE 2: CONCLUDING THE AGREEMENT

2-1 Creating an account

The customer must create a personal account on the website to be able to place online orders. The customer must provide valid and accurate personal information, including their surname, first name, address, phone number and email address.

Magstein Sàrl accepts no responsibility for misuse or misappropriation of the account resulting from the accessing or use of the holder's password and account login details by a third party.

2.2. Verifying your order

The customer shall be responsible for checking all details on the payment page before placing the order, including specific details.

2.3 Receiving your order

Once you have placed your order in the online shop, www.magstein.ch will send you an email confirming receipt of the details in the order. The invoice for your purchase will be attached to this confirmation email in PDF format. If you do not receive an order confirmation within 24 hours, please contact us by email at: info@magstein.ch

ARTICLE 3: PAYMENT METHODS

Payment must be made before Magstein Sàrl can ship the products, either by credit card or Twint. Our product prices can be displayed in Swiss Francs, Euros or Dollars. Transactions are processed in Swiss Francs.

ARTICLE 4: TAXES

VAT

Deliveries within Switzerland are subject to the application of VAT (Value Added Tax) at 7.7%.

Foreign taxes

Swiss VAT is deducted for deliveries abroad, however customs duties and VAT must be paid in your own country when you receive the parcel. We accept no responsibility in such cases. It is therefore the customer's responsibility to obtain the necessary information from the competent authorities in the country in which the order was placed.

ARTICLE 5: AVAILABILITY AND DELIVERY TIME

Unless otherwise specified, the delivery time for a standard delivery within Switzerland is 7 days after the order confirmation email is sent. However, these times are provided for information only. Magstein Sàrl makes every effort to process orders as quickly as possible.

ARTICLE 6: RETURNS AND WARRANTY

In the event that an item is damaged during transport by one of our carriers (packaging also damaged), the customer must immediately file a claim with the carrier.

The customer must check the condition of the goods immediately upon delivery. 

If the customer's reasonable inspections reveal the existence of defects or delivery and/or quantity errors, the customer must notify Magstein Sàrl in writing within 15 days of receiving the goods. 

If a major defect is found, Magstein Sàrl will replace the goods or supply the missing items. If a delivery and/or quantity error is found, Magstein Sàrl will replace the goods or supply the missing items. If Magstein Sàrl is unable to replace the goods or complete the delivery, the goods will be recalled.

If the customer subsequently discovers a defect that could not be found during the initial inspection, they must immediately notify Magstein Sàrl in writing. 

The goods to be replaced must be returned to the address below, including the reason for the replacement:

6.1 Limitation of warranty and liability for defects 

Magstein Sàrl guarantees that the products it supplies are free from manufacturing and/or material defects.

Magstein Sàrl accepts no liability for products which have been altered or modified by the customer, and offers no warranty for any such products.

Magstein Sàrl accepts no liability for any assembly or disassembly costs, nor for any damages resulting either directly or indirectly from the delivered products themselves, their use or any hidden defects. Magstein Sàrl accepts no liability for consequential or other damages, in particular for a loss of income. 

Claims for damages made by the customer based on the negligent breach by Magstein sàrl of its contractual or legal obligations are excluded. 

ARTICLE 7: GOVERNING LAW

All legal relations between the customer and Magstein Sàrl are governed by Swiss law.
